Terms of Service
Last updated: 26 July 2026
This Service is offered only for business use. If an English and Lithuanian version conflict, the Lithuanian version prevails.
1. Provider and Scope
These Terms of Service govern access to and use of PLN System, a work and project management platform for surveyors and related professional teams.
The Service is provided by Jonas Liubinas, Vilkpėdės 9, Vilnius, Lithuania, contact email: [email protected].
2. Business-Only Use
The Service is intended only for business and professional use. It is not offered for private consumer use.
By creating an organization account or using the Service on behalf of a business, you confirm that you are at least 18 years old and legally authorized to bind that business or organization.
3. Service Description and Beta Status
The Service currently provides tools for planning, managing, and documenting surveying work, including task management, team collaboration, customer records, files, scheduling, and related operational workflows.
As of 26 July 2026, the Service is offered as a free beta / early-access service with one free plan only. The current free beta offer is intended to run until 31 December 2026, unless ended, extended, modified, or replaced earlier.
Free, beta, trial, and other non-paid plans or features may be changed, limited, suspended, or ended immediately, without consent, prior notice, compensation, or any commitment to continued availability, to the maximum extent permitted by applicable law.
4. Registration and Accounts
You must provide accurate and up-to-date registration information. You are responsible for maintaining the confidentiality of account credentials and for activities occurring under your organization account and user accounts issued within your organization.
Invited users receive separate credentials, but their use remains subject to these Terms and, where applicable, the instructions of the organization administrator or owner.
5. Acceptable Use
You may use the Service only in a lawful, professional, and responsible manner. You must not use the Service to upload, store, send, or process content or activity that is unlawful or harmful.
- Use the Service for illegal, fraudulent, abusive, harassing, defamatory, obscene, infringing, or malicious purposes.
- Upload malware, harmful code, exploit tools, or material intended to disrupt the Service or third parties.
- Attempt unauthorized access, interfere with security, bypass usage restrictions, or test the Service in a destructive manner without permission.
- Upload or share content that you do not have the right to use, disclose, or process.
- Use the Service in a way that creates legal, technical, or security risk for the Provider, other customers, or third parties.
6. Customer Data, Privacy, and DPA
As between the parties, the customer organization retains responsibility for Customer Data entered or uploaded into the Service. The customer remains responsible for having a valid legal basis, required notices, and necessary permissions for all personal data and content it places in the Service.
The Provider acts as an independent controller for account, identity, billing, security, support, and service administration data, and acts as a processor for Customer Data processed on behalf of the customer organization within the Service.
Where GDPR or similar laws require a processor agreement, the Data Processing Agreement made available with the Service forms part of these Terms and is incorporated by reference.
7. Intellectual Property and Customer Content
The Provider and its licensors retain all rights, title, and interest in the Service, software, design, branding, documentation, and related intellectual property, excluding third-party open-source components that remain subject to their own licenses.
The customer retains ownership of Customer Data and other content it uploads or enters into the Service. The customer grants the Provider a non-exclusive right to host, copy, process, transmit, display, and otherwise use that content only as necessary to operate, secure, maintain, support, and improve the Service for the customer organization.
8. Fees and Future Paid Plans
The Service is currently free of charge. No subscription fees, setup fees, billing cycles, payment providers, auto-renewals, manual renewals, or refunds currently apply.
If paid plans or paid features are introduced in the future, pricing, billing terms, renewal terms, payment provider details, invoice timing, and any refund policy will be published in advance and will require acceptance before charges apply.
A customer may cancel a paid plan at any time. If a paid period was prepaid and ends before the end of that prepaid period for reasons other than the customer’s non-payment or other material breach, the Provider will refund the unused prepaid portion on a pro rata basis unless mandatory law requires a different outcome.
If a customer fails to pay undisputed amounts when due, the Provider may immediately suspend access to the paid plan or Service. If the payment default is not cured within 14 days after written notice, the Provider may terminate the paid plan and process associated Customer Data in accordance with the Service suspension and deletion process described in these Terms, the Privacy Policy, and the DPA.
9. Availability, Changes, and No Warranty
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, the Provider does not guarantee that the Service will be uninterrupted, error-free, secure against every possible threat, or fit for every customer purpose.
The Provider may modify, suspend, restrict, or discontinue any part of the Service, including the free beta offering. Free, beta, trial, and other non-paid plans may be changed or discontinued immediately without prior notice where the Provider decides to do so. For paid plans, the Provider will use reasonable efforts to give advance notice of material adverse changes where practicable, except where immediate action is reasonably necessary for security, legal, abuse-prevention, operational, or non-payment reasons.
Where the Provider gives notice about material changes to the Terms of Service, Privacy Policy, or DPA, the Provider may send that notice to the organization registration email used at signup and will make the current legal documents available in English and Lithuanian.
10. Suspension, Termination, and Deletion
The Provider may suspend, restrict, or terminate access to free, beta, trial, and other non-paid plans at any time, with or without notice, to the maximum extent permitted by applicable law.
For paid plans, the Provider may suspend or terminate access for important reasons, including material breach, unlawful use, security, technical or legal risk, abuse, or non-payment of undisputed amounts when due. Where the Provider terminates a prepaid paid plan for reasons other than the customer’s non-payment or other material breach, the Provider will refund the unused prepaid portion on a pro rata basis unless mandatory law requires otherwise.
If a paid plan is suspended or terminated because of non-payment or other material breach, the Provider may immediately block access and may retain Customer Data for a limited period reasonably necessary to handle cure, disputes, refunds, legal obligations, security, and deletion processing before final deletion.
The organization owner may request organization deletion through the Service. After a deletion request, the organization enters a 7-day grace period. During that period the organization is write-locked. After the grace period, deletion is finalized.
Non-owner members may delete their own account from PLN Mobile. Members who can no longer sign in may use the public account-deletion process made available by the Provider.
On successful individual account deletion, the member’s access, sign-in identity, and credentials are removed and the member’s email address is released. Individual account deletion does not delete the organization or its organization-controlled work records. Direct profile identifiers are anonymized within 90 days; work, audit, and billing records may be retained as described in the Privacy Policy, DPA, and applicable law.
11. Limitation of Liability
To the maximum extent permitted by law, the Provider is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, or reputational harm.
The Provider’s total aggregate liability arising out of or relating to the Service or these Terms is limited to the greater of: (a) the fees actually paid by the customer for the Service during the 6 months immediately preceding the event giving rise to the claim; or (b) EUR 100.
Nothing in these Terms excludes liability that cannot lawfully be excluded or limited under applicable law.
12. Indemnity
The customer agrees to defend, indemnify, and hold harmless the Provider against third-party claims, losses, liabilities, damages, costs, and expenses arising from or related to the customer’s unlawful content, misuse of the Service, violation of these Terms, or infringement of third-party rights by Customer Data or customer conduct.
13. Force Majeure
The Provider is not liable for delay or failure to perform caused by events beyond reasonable control, including acts of God, war, terrorism, civil unrest, labor disputes, power failures, telecommunications failures, internet outages, hosting incidents, or government action.
14. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Lithuania, excluding conflict-of-law rules. Any dispute arising from or related to these Terms or the Service will be subject to the courts of Lithuania, unless mandatory law requires otherwise.
